No.18721 of 2020 and batch cases reported in 2021 (1) CTC 839 by disposing of the representation of the Petitioner herein dated 02.02.2026 and 09.02.2026 following the common Judgement and Decree dated 26.09.2025 made in O.S. Nos. 202 of 2013 and 78 of 2016, on the file of the I Additional District and Session Judge, Cuddalore.

ORDER

Mr.U. Baranidharan, learned Special Government Advocate takes notice for respondents. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

2. It is stated that the petitioner sought deletion of encumbrance entries relating to Doc. Nos.5728, 5729 and 5770 of 2025 on the file of the 4th respondent/Sub-Registrar, in the light of the common Judgment and Decree dated 26.09.2025 passed in O.S. Nos.202 of 2013 and 78 of 2016 by the learned I Additional District and Sessions Judge, Cuddalore, declaring the settlement deeds as null and void. But till date, the same has not been considered by the respondents. Hence this writ petition.

3. Learned counsel for the petitioner submitted that despite the decree, certain entries continue, and hence, the petitioner sought for deletion. 2/4

Therefore, he prayed that it would suffice, if a direction is issued to the respondents to consider the representations, lastly submitted on 09.02.2026, within a time frame.

Learned counsel for the respondents submitted that the 4th respondent will consider the petitioner's representations and he submitted that the main entry will not be deleted and other entries will be deleted in line with the common judgment passed in O.S. Nos.202 of 2013 and 78 of 2016. Hence, this Court may issue suitable directions in the above regard.

5. Considering the aforesaid submissions, this Court, without expressing any opinion on the merits of the case, directs the 4th respondent to consider the petitioner's representations, lastly submitted on 09.02.2026 and make appropriate entries/endorsements in the relevant records in the light of the Judgment and Decree passed in O.S. Nos.202 of 2013 and 78 of 2016 by the learned I Additional District and Sessions Judge, Cuddalore, within a period of eight weeks from the date of receipt of a copy of this order.

6. With the above directions, this writ petition stands disposed of. No costs.
