PRAYER : This writ petition has been filed under Article 226 of the Constitution of India to issue a writ of mandamus directing the respondents to pay interest at 10 %for the belated payment of Gratuity P. ORDER
The instant writ petition has been filed to consider the petitioner's representation dated 24.02.2025 claiming interest for the delayed payment of terminal benefits and also for the payment of EL surrender.

The learned counsel for the petitioner submitted that he was working as Assistant in the first respondent corporation and retired from service on 30.04.2023, on attaining the age of superannuation in the cadre of Senior Superintendent. However, the terminal benefits have been settled to petitioner only on 30.10.2024 and no interest has been paid for the delayed period. In view of the same, on 12.02.2025, the petitioner has sent a representation to the respondent to pay interest for the delayed period. Since the same was not considered, the present Writ Petition has been filed. 2/5
3. The learned counsel for the respondent would fairly submit that they will pay 6% interest on the eligible retirement benefits of the petitioners. However, in respect of surrender leave salary, he submits that according to the records, if there is any amount due to the petitioner, they will pay the same within a reasonable time.

Considering the above submission, this Court deems it appropriate to direct the respondents to pay interest at the rate of 6% upon the terminal benefits for the delayed payment, from the date of retirement till the date of actual disbursal of the terminal benefits to the petitioner, and also directs the respondent to pay the difference in salary, EL surrender, according to their records, if eligible, with applicable interest, within the period of six weeks from the date of receipt of a copy of this order.
5. With the above observations and directions, this writ petition is disposed of. No costs.
