ORDER

The instant writ petition has been filed to consider the petitioners' representation dated 21.02.2025 claiming interest for the delayed payment and also for the payment of EL surrender and last 10 days salary.

The learned counsel for the petitioners submitted that they were working as Conductors in the respondent corporation and retired from service on 31.01.2023 and 28.02.2023 accordingly, on attaining the age of superannuation in the cadre of Special Grade Conductors. However, the terminal benefits have been settled to petitioners only on 30.10.2024 and no interest has been paid for the delayed period. In view of the same, on 21.02.2025, the petitioners have sent representations to the respondent to pay interest for the delayed period. Since the same was not considered, the present Writ Petition has been filed.

3. The learned counsel for the respondent would fairly submit that they will pay 6% interest on the eligible retirement benefits of the petitioners. However, in respect of surrender leave salary and last 10 days' salary, he submits that according to the records, if there is any amount due to the petitioners, they will pay the same within a reasonable time. 2/4

Considering the above submission, this Court deems it appropriate to direct the respondent to pay interest at the rate of 6% upon the terminal benefits for the belated payment, from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioners, and also directs the respondent to pay the difference in salary, EL surrender and last 10 days' salary, according to their records, if eligible, with applicable interest, within the period of six weeks from the date of receipt of a copy of this order.

5. With the above observations and directions, this writ petition is disposed of. No costs.
