The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 323, 364-A, 365, 342, 386 and 506(1) of IPC, in Crime No.280 of 2022, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner along with other accused kidnapped the son of the defacto complainant and also the defacto complainant's sister's son, under the guise of police officials and also demanded ransom amount. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Additional Public Prosecutor submits that there are totally 10 accused in which the petitioner is arrayed as A5. The petitioner played a main role in kidnapping and also demanded huge sum of amount from the defacto complainant. He would also submit that there is no change of circumstances after the previous dismissal order passed by this Court. 5. Taking into consideration the facts and circumstances of the case and the bad antecedents of the petitioner, the custodial interrogation of the petitioner is very much required in this case. Hence, this Court is not inclined to grant anticipatory bail to the petitioner.
