IN THE HIGH COURT OF JUDICATURE AT MADRAS

Dated : 01.06.2015 Coram The Honourable Mr.Justice D.HARIPARANTHAMAN W.P.No.3768 of 2015 and M.P.No.1 of 2015 D.Anandhan [ Petitioner ] Vs 1 The Collector Villupuram District 2 The Revenue Divisional Officer Thirukovillur District 3 The Tashildar Thirukovillur Taluk Villupuram District 4 Mr.Parthiban [Respondents ] Prayer: Writ petition is filed under Article 226 of Constitution of India, seeking a writ of mandamus to direct the 1st and 2nd respondent to appoint the petitioner for the post of Village Assistant for Sorayapattu Village Kzhumaram Post Thirukovilur Taluk Villupuram District on the basis of the Interview conducted by the 3rd respondent on 11.12.2014.

For Petitioner :

O R D E R

The petitioner has filed this writ petition seeking for a direction to the respondents 1 and 2 to appoint him as Village Assistant for Sorayapattu Village , Thirukovilur Taluk, Villupuram District.

2. On 10.04.2015, this Court has passed the following order:- "The petitioner states in para 3 of the affidavit filed in support of the writ petition that he was called to attend interview for the post of Village Assistant, along with others, on https://hcservices.ecourts.gov.in/hcservices/

28.11.2014.

According to him, the fourth respondent was appointed to the said post though he is junior to him. The petitioner has not chosen to question the appointment of the fourth respondent, but has filed this writ petition seeking to give him appointment as Village Assistant for spondent to appoint the petitioner for the post of Village Assistant for Sorayapattu Village, Thirukovilur Taluk, Villupuram District.

2. In my view, the petitioner cannot ask for such direction and at the most, he could question the appointment given to the fourth respondent.

3. The learned counsel for the petitioner seeks time. Hence, post this matter for orders on 24.04.2015".

3. As already observed, since no such a direction as sought for by the petitioner would be granted, this writ petition is dismissed. However, the dismissal of the writ petition would not stand in the way of the petitioner questioning the appointment of the fourth respondent as Village Assistant. No costs. Connected miscellaneous petition is closed.
