Appeal and counter appeal arise out of the interim order passed by the Family Court in I.A. No.2832 of 2012 in H.M.O.P. No.2166 of 2012 on the file of the Principal Family Court, Chennai.

2. The interlocutory order under challenge relates to the grant of interim maintenance pending disposal of the H.M.O.P No.2166 of 2012. It is brought to the notice of this Court that H.M.O.P No.2166 of 2012 was dismissed on 29.03.2019 by a common order passed along with H.M.O.P. No.4042 of 2014, and the appeals in C.M.A. Nos.4655 and 4657 of 2019 are pending before this Court. Since these two appeals arise out of an interlocutory application which has subsequently merged with the final order, they have become infructuous and are accordingly dismissed as infructuous.

3. We also take note of the submission made by the learned counsel that, in respect of maintenance, the wife has initiated separate criminal proceedings, which are pending in M.C. No.313 of 2020.
