C O M M O N O R D E R The Writ Petitions in W.P.No.21718/2016 etc. batch have been filed seeking a common relief, challenging the impugned order passed by the Assistant Settlement Officer (South-inCharge), Office of the Director of Land Revenue, Survey and Settlement, Chepauk, Chennai-5 dated 10.12.2015 and to set aside the same.

Heard the learned Counsel for the respective petitioners and Mr.V.S.Sethuraman, the learned Additional Advocate General assisted by Mr.R.Govindasamy, learned Special Government Pleader appearing for the State. I have also perused the materials available on record carefully.

At the outset, the impugned orders dated 10.12.2015 passed in all these Writ Petitions have to be necessarily set aside and remanded back to the Assistant Settlement Officer (South-in-Charge), Office of the Director of Land Revenue, Survey and Settlement, Chepauk, Chennai-5 for two reasons. Firstly, paragraph 10 of the impugned order proceeds on the footing that the petitioner had not filed any document in support of their claim, ignoring the factual position that 342 documents filed by the petitioner before the Original Authority, namely, the Assistant Settlement Officer, Madurai were already on record. The marking of 342 documents were shown as Ex.R.1 to 342 in the order dated 11.7.1980.

Therefore, the reason given for rejecting the claim of the petitioner that they had not filed any document in support of their claim is not only reflecting the non-application of mind, but also the perverse finding of the Assistant Settlement Officer, Chennai. Moreover, the Assistant Settlement Officer, Chennai, who had to appreciate the entire documents filed by both the parties to answer the claims and counter claims made by both parties has committed grave error in not considering the said documents. In the light of the well settled legal position that non-consideration of evidence on record would vitiate the entire proceedings, the impugned order is liable to be set aside.

Further, the Assistant Settlement Officer, Chennai, having given a finding that the petitioners have not filed any document in spite of the fact that 342 documents were already on their file, he had miserably failed to appreciate and give a finding thereon. This shows his total non-application of mind to the pleadings. It is well settled legal position that if an authority passes an order overlooking or ignoring the available documentary evidence produced by the party, any such order is liable to be set aside. 4.

Secondly, when the petitioners approached the Madurai Bench of this Court with W.P.(MD).No.13980/2015 seeking Mandamus

directing the Assistant Settlement Officer, Madurai to send the entire file and records in respect of the Proceedings SR 1 to 592/Amb/79 to the 2nd respondent, namely, the Assistant Settlement Officer (South-in-Charge) Office of the Director of Land Revenue, Survey and Settlement, Chepauk, Chennai-5 and W.P. (MD) No.896/2016, the learned Additional Advocate General who represented all these matters has not even brought to the notice of the learned Single Judge that an order was already passed on 10.12.2015. Since that factum was not brought to the notice of the Court, a direction was given to the Assistant Settlement Officer at Chennai therein to look into all the files and pass appropriate orders.

In view thereof, the petitioners are under the impression that the matters remanded back to the Assistant Settlement Officer (South-in-Charge), Chennai are pending. Moreover, in the light of the said order passed in W.P.(MD) Nos.13980/2016 and 896/2016 dated 2.3.2016, the time for filing the appeals within 3 months as contemplated under Section 12(2) of Tamil Nadu Regulations, Estates and Inams Abolition and Ryotwari Settlement Acts stood lapsed and thereby they cannot prefer any appeal now as it is time barred and as it is well settled that Actus Non Facit Reum Nisi Mens Sit Rea, namely, no person should be prejudiced by an act of court, the impugned order has to go.

For all these above reasons, this Court, is of the considered view that the impugned order dated 10.12.2015 passed by the Assistant Settlement Officer (South-in-Charge), Chennai-5 is liable to be set aside. Accordingly, the impugned orders dated 10.12.2015 in all these Writ Petitions are set aside and the matters are remanded back to the file of the Assistant Settlement Officer (South-in-Charge), Chennai. 6.

At this stage, the learned Counsel appearing for the petitioners made a joint request to this Court to give a direction to the Assistant Settlement Officer (South-in-Charge) to dispose of the matters on merits expeditiously on the available documents. In any event, since there was an unprecedented flood took place in the month of December, 2015 and many of the documents were washed out even from the office of the Assistant Settlement Officer (South-in-Charge), Chennai and from the office of the learned Counsel for the petitioners, this Court grants two months time to all the parties to make their documents available, if so advised and on receipt of the same, the Assistant Settlement Officer (South-in-Charge), Chennai, shall consider the same. The 2nd respondent is also directed to ensure before proceeding to hear the parties that all the documents filed by both parties are available on record. If any document of the petitioner or the respondent is not available, 30 days time shall be given to the parties to produce those documents. On receipt of the same, the matters shall be

taken up by the Assistant Settlement Officer, Chennai, who in turn, shall hear the parties and dispose of the same on merits and in accordance with law, within a period of six months thereafter.

With the above observation and direction, the writ petitions are disposed of. No costs. Consequently, connected Miscellaneous Petitions are closed.
