Petition praying that in the circumstances stated therein the High Court will be pleased To suspend the sentence imposed by the Learned Mahila Session Judge, Cuddalore in S.C.No.16/2016 dated 17.05.2017 and enlarge the petitioner on bail pending disposal of the above said Criminal Appeal and pass such further or other orders as this Honble Court.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.C.SAMIVEL, Advocate for the petitioner and of MR.J. KARUPPIAH, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- (Order of the Court was made by S.Manikumar,J) Though Mr.C.Samivel, learned counsel for the appellant sought for suspension of sentence, on the grounds inter alia that prosecution has not made out a case, going through the impugned judgment, we are not inclined to accept the said contention.

2. Conviction and sentence, recorded on the basis of proper appreciation of evidence and at this juncture, we are not inclined to suspend the sentence.

3. Civil Miscellaneous Petition is dismissed. -sd/- 04/09/2017 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.) High Court, Madras - 600 104.
