ORDER
The petitioner, who apprehends arrest at the hands of the respondent police, for the alleged offences punishable under Sections 296, 115(2), 118(2) and 351(4) of BNS in Crime No. Not known of 2026, seeks anticipatory bail.
2. Today, when the matter was taken up for hearing, the learned Government Advocate (Crl.Side) appearing for the respondent Police submitted that the petition enquiry in C.S.R.No.155 of 2026, is pending against the petitioner.
3. Having heard the learned counsel appearing on both sides and upon perusal of the materials available on record and considering the facts and circumstances of the case, this Court directs the respondent police to issue appropriate notice to the petitioner under Section 35(3) of BNSS for enquiry. On receipt of such notice, the petitioner shall appear for enquiry and co-operate in the investigation. It is made clear that the investigating officer must conduct the enquiry by strictly following the procedures therein and if any cognizable offence is made out, the investigating officer shall register a First Information Report or close the petition enquiry within a period of two weeks from the date of receipt of a copy of this order. The parties are directed to cooperate in the enquiry. It is needless to say that the respondent police shall not take any coercive steps to secure the accused till the completion of enquiry, on the complaint lodged by the de facto complainant.
4. With the above directions, this Criminal Original Petition is disposed of.
