Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the 2nd respondent and the 3rd respondent to consider and dispose of the petitioners applications relating to patta transfer and sub-division, including online Application No.2025 /0105 /18 /469854 dated 07/08/2025 and Application No.2026/0105 /18/008826 dated 02/03/2026 and consequently to conduct survey, measure the land, demarcate the boundaries and effect sub- division in respect of the petitioners property comprised in Survey No.71 /11 A, Patta No.61, situated at Melkangeyankuppam
Village, Panruti Taluk, Cuddlaore District, and consequently directing the 4th respondent to provide adequate and effective police protection to the revenue and survey officials at the time of conducting survey, measurement, demarcation of boundaries and sub division of the aforesaid property, in the event of obstruction or reasonable apprehension of obstruction. ORDER
This writ petition has been filed to direct the respondents to consider the petitioner's applications dated 07.08.2025 & 02.03.2026.
2. Ms.Inthu Karunakaran, learned Government's counsel, takes notice on behalf of the respondents.
3. By consent of the parties, the main petition is taken up for disposal in the stage of admission itself.
4. The learned counsel for the petitioner would submit that in this case, the petitioner wanted to sub-divide the subject properties, which not only belongs to him, but also to one Kasi Ammal. In this regard, he filed a representation before the respondents. However, the said representation was not at all considered by the respondents till date. Hence, this petition.
5. In reply, the learned Government's counsel appearing for the respondents would submit that not only the petitioner, but also one Kasi Ammal, is entitled for the subject property. However, the representation was filed without obtaining consent from the said Kasi Ammal. Hence, she would submit that if any application is filed along with the consent, the same will be considered in accordance with law. Thus, she requests this Court to pass appropriate orders.
6. Heard the learned counsel for the petitioner and the respondents and also perused the entire materials available on record.
7. In the case on hand, the petitioner filed a representation before the respondents to sub-divide the subject properties, which not only belongs to him, but also to one Kasi Ammal. In such case, it is necessary for the petitioner to obtain consent from the said Kasi Ammal for sub-dividing the subject property. However, now, the petitioner filed a representation without any such consent. Under these circumstances, no direction can be issued to the respondents to consider the petitioner's representation.
8. Therefore, this Court is inclined to dismiss the present petition as devoid of merits. Accordingly, this writ petition is dismissed. No cost. The
liberty is granted to the petitioner to file a fresh representation along with consent of the co-owner, viz., Kasi Ammal. If there is any dispute on the part of said Kasi Ammal in giving consent for sub-division, the petitioner can very well file a suit for partition before the Civil Court. 08-06-2026 Index: Yes/No Speaking/Non-speaking order nsa To
