Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondents to consider the representation of the petitioner dated 25.09.2015 and vacate and hand over possession of the property of the petitioner being land measuring 1090 sq.ft. or thereafter at Old Court Road, Gudalur occupied by the third respondent for fire station and pay compensation towards monetary loss and mental agony within such time as may be prescribed by this Court. By consent, the main writ petition is taken up for final disposal at the admission stage itself.

The petitioner is the owner of the land measuring about 1090 sq.ft at Old Court Road, Gudalur and it was let off https://hcservices.ecourts.gov.in/hcservices/

on rent to respondents 2 and 3. It is the case of the petitioner that despite time having been granted for vacating the property, which was also agreed to by respondents 2 and 3, they are not vacating the same. According to the petitioner, they are neither paying the fair rent fixed nor vacating the property. Hence, the petitioner made a representation to the 1st respondent on 25.09.2015 to direct respondents 2 and 3 to vacate and hand over the aforesaid property to the petitioner. As the said representation did not evoke any response, the petitioner has come forward with the present writ petition. 3.

Considering the pendency of the representation of the petitioner dated 25.09.2015 before the 1st respondent, the 1st respondent is directed to pass appropriate orders on the said representation, on merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs. Connected M.P. is closed.
