Respondents Prayer:- Writ petition has been filed under Article 226 of the Constitution of India praying for the issuance of Writ of Certiorarfied Mandamus calling for the records of the learned Chief Judicial Magistrate, Coimbatore culminating in Cr.M.P.No.1161/2019 dated 04.01.2020 and quash the same and further direction to the 1st respondent / Bank not to take any coercive steps in taking physical possession of the petitioner property in Door No.39/69, Sir Shanmugham Road, R.S.Puram, Coimbatore 641 002 in pursuance of the order dated 04.01.2020 in Cr.M.P.No.1161/2019 of the learned Chief Judicial Magistrate, Coimbatore.

ORDER

[Order of the Court was made by M.SATHYANARAYANAN,J.,] The learned counsel appearing for the petitioner after advancing arguments, seeks permission of this Court to withdraw this Writ Petition, with liberty to file an appeal remedy before the competent Forum.

2. This Court heard the submission of Mr.M.L.Ganesh, learned standing counsel appearing for the 1st respondent also.

3. The learned counsel appearing for the petitioner also undertakes to send necessary endorsement through e-mail to the Registry of this Court.

4. In the light of the same, the Writ Petition is dismissed as withdrawn and if the petitioner is so advised and if it is available to her under law, she is at liberty to avail the appropriate appeal remedy before the competent Forum. No costs.
