Respondents PRAYER: Writ Petition filed under Article 226 of The Constitution of India praying to issue a writ of mandamus, directing the respondents herein to act upon the selection of the petitioner as part-time sweeper and temporary sub-staff based on his registration with the Employment Exchange and consequent selection and in any event appoint him on the strength of his Schedule Tribe reserved-status in a suitable permanent vacancy as sub-staff.

O R D E R

The relief sought for in this Writ Petition is for a direction, directing the respondents herein to act upon the selection of the petitioner as part-time sweeper and temporary sub-staff based on his registration with the Employment https://hcservices.ecourts.gov.in/hcservices/

Exchange and consequent selection and appoint him on the strength of his Schedule Tribe reserved-status in a suitable permanent vacancy as sub-staff.

2.The prayer as such sought for in this Writ Petition cannot be granted. This Court is of the firm view that the appointment can never be claimed as a matter of right by the candidates. A mere participation in the interview will not confer any right on the candidate to seek an order of appointment. In the case on hand, the writ petitioner has not established any legal right. This apart, the learned counsel appearing for the respondents brought to the notice of this Court that the writ petitioner has been already appointed as an Office Assistant on permanent basis in Government Girls Higher Secondary School at Poigai, near Vellore. Thus, the relief sought for in this Writ Petition deserves no further concentration. Even otherwise also, the claim of the writ petitioner cannot be considered in view of the fact that the writ petitioner is not an aggrieved person under law and has not established even a semblance of legal right. 3.Accordingly, this Writ Petition stands dismissed. However, there is order as to costs. Consequently, connected miscellaneous petition is closed.
