This petition is filed to transfer the investigation from the file of the second respondent to the first respondent to take up the investigation and investigate the same.
2. Heard Ms.C.Shyaamala, learned counsel for the petitioner and Mr.C.Emalias, learned Additional Public Prosecutor appearing for the respondents.
3. It is seen that the petitioner lodged a complaint dated 27.01.2015 before the first respondent Police and that has been transferred to the second respondent for investigation, for want of jurisdiction.
4. The learned Additional Public Prosecutor submits that no regular case has been registered, only petition enquiry is pending. https://hcservices.ecourts.gov.in/hcservices/
5. The petitioner wants to transfer the investigation from the file of the second respondent to the first respondent. This may not be permissible, because, a regular case is yet to be registered by the Police.
6. In the said circumstances, this Court in the interest of justice, direction is given to the second respondent to expeditiously conduct the enquiry on the complaint dated 27.01.2015 given by the petitioner and take action in accordance with law, laid down by the Hon'ble Supreme Court in Lalita Kumari Vs. Government of Uttar Pradesh and others reported in (2014) 2 SCC 1.
