This petition has been filed to direct the Inspector of Police, Kodungaiyur Police Station, the 3rd respondent herein to find out and produce their brother Bala Kamatchi @ Balaji, who is missing from the year 2020.
2. On the complaint lodged by the 4th respondent, alleging that her brother, Bala Kamatchi @ Balaji, is missing since 09.12.2020, the 3rd respondent registered the F.I.R in Crime No. 1542 of 2020 under 'man missing.' Thereafter, the 3rd respondent published his photograph in and around the locality. Though the petitioner impleaded the 4th respondent, who is the wife of the petitioner's brother, the petitioner now alleges that the 4th respondent is the
reason behind the petitioner's brother missing. In fact, it was the 4th respondent who lodged the complaint and based on that complaint, the 3rd respondent registered the F.I.R. Further, during enquiry, no relevant information was obtained from the 4th respondent regarding the whereabouts of her husband. Therefore, the direction sought by the petitioner cannot be considered since the investigation is still pending.
3. In view of the above, this Criminal Original Petition is dismissed. The 3rd respondent is directed to complete the investigation and file final report within a period of 16 weeks, from the date of receipt of copy of this order.
