This Criminal Original Petition has been filed by the petitioners/A2 & A3, who were arrested and remanded to judicial custody on 18.05.2024, seeking bail in Crime No.131 of 2024 for the alleged offences punishable under Sections 269, 270, 506(ii) of IPC altered into Sections 269, 270, 417, 419, 468 and 506(ii) of IPC.

2. Learned counsel appearing for the petitioners submitted that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners have nothing to do with the alleged offence and they are in custody from 18.05.2024. He also submitted that the petitioners are ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for granting bail to the petitioners.

3. Learned Government Advocate (Criminal Side) appearing for the respondent police raised objection for granting bail to the petitioners stating that the accused had transported the medical waste from Kerala and dumped the same in storage ware house in Tamil Nadu. 4. He further submitted that the investigation in this case is still pending and since the petitioners are the native of Kerala, if they are released on bail at this stage, there is a possibility of them absconding and not available for further investigation.

5. Considering the submissions made by the learned Government Advocate (Crl.Side) that the investigation is at initial stage and also considering the gravity of the offence committed by the accused, this Court is not inclined to grant bail to the petitioners.
