The instant writ petition has been filed with a prayer for issuing a Mandamus, to direct the 1st respondent to consider the representation sent by the petitioner dated 10.03.2025 to settle the subsistence allowance along with employ provident fund with interest.
2. From the perusal of the representation dated 10.03.2025, it is clear that though initially the petitioner was suspended from service as early as on 13.07.2002, thereafter a after full fledged disciplinary proceeding was conducted, and as a consequence dismissed from service on 24.01.2025. 2/5
3. Heard the learned counsel for both sides and perused the materials available on record.
4. In such view of matter, long delay of more than 23 years for pursuing the subsistence allowance by sending a representation cannot be encouraged. The mere representation after a long lapse of time will not be allowed to give a fresh cause of action to the petitioner's claim.
5. Therefore, this Court do not find any merits in the present writ petition. Hence, this writ petition is dismissed. No costs. 06.06.2025 jas Index : Yes/No Speaking order /Non Speaking Order 3/5
