Respondents Prayer: The Writ Petition is filed under Article 226 of the Constitution of India, seeking for a Writ of Mandamus, directing the respondents 1 to 3 to conduct a fair enquiry by affording an opportunity to the petitioner along with documentary proofs before initiating any proceedings pertaining the property viz., Plot D, Old No.58, New No.1/58 in T.Nagar, Ramanathapuram Co-operative House building Society Ltd., A,2102 in 8/173 Trichy Road, Coimbatore Taluk and District in the registration Sub District of Coimbatore and within the jurisdiction of Coimbatore Municipality measuring 1185 sq.ft. The petitioner has come forward with the present writ petition seeking for issuance of writ of mandamus, directing the respondents 1 to 3 to conduct a fair enquiry, by affording an opportunity to the petitioner along with documentary proofs before initiating any proceedings pertaining to the schedule mentioned property.

2. Heard Mr.G.V.Sridharan, learned counsel for the petitioner, Mr.K.Magesh, learned counsel appearing for the first respondent and Mr.V.Shanmuga Sundar, learned Special Government Pleader appearing for the respondents 2 to 4.

3. The case of the petitioner is that her husband purchased the property in dispute from the fourth respondent by way of registered sale deed dated 18.5.1984. It is further stated that the first respondent - Corporation, treating the land as a place allotted for public purpose in the approved layout has affixed a notice in the office of the fourth respondent. Since the petitioner was not given any opportunity, the present writ petition has been filed.

The learned Standing counsel appearing for the first respondent submitted that the petitioner claims right over the land allotted for public purpose i.e., children playing area and therefore the claim has no basis. The first respondent would take further action only after affording an opportunity to the petitioner.

5. The learned Special Government Pleader submitted that the respondents 2 and 3 gave approval for the layout and there is no substance in the allegations made against them in the writ petition.

6. In the light of the submission of the learned standing counsel for the first respondent, this writ petition is disposed of with a direction to the first respondent to take action against the petitioner after providing an opportunity of personal hearing and in accordance with law.
