Writ Petition filed under Article 226 of the Constitution of India seeking a writ of mandamus directing the respondents to consider and take necessary action based on the petitioner's representations dated 22.04.2021 and 22.03.2024, thereby requesting to remove the encroachments made by the sixth and seventh respondents within the water body comprised in S.No.50/4, Melathikan Village and Post, Tiruvannamalai Taluk and District measuring an extent of 0.43.5 hectares within a time frame.

ORDER

(Made by the Hon'ble Acting Chief Justice) Heard the learned counsel for the petitioner, learned State Government Pleader appearing for the respondents 1 to 3 and 5 and the learned Government Advocate appearing for the fourth respondent. Notice to the sixth and seventh respondents is dispensed with inasmuch as no order prejudicial to their interest is passed in this writ petition.

Seeking removal of encroachments made by the sixth and seventh respondents in the water body measuring an extent of 0.43.5 hectares in S.No.50/4, Melathikan Village and Post, Tiruvannamalai Taluk and District, the petitioner addressed representations dated 22.04.2021 and 22.03.2024 to the first respondent and second respondent, respectively, and finding no response to the same, the petitioner has filed this writ petition for a mandamus directing the authorities to take appropriate action based on his representations.

Considering the nature of the relief sought by the petitioner and also the fact no action has been taken on the representation addressed to the first respondent for more than three years, without going into the merits of the case, this Court directs the first and second respondents to consider and pass orders on the petitioner's representation dated 22.04.2021 and 22.03.2024, respectively, on their own merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this

order, of course, after hearing all the parties concerned. With the above direction, this writ petition stands disposed of. No costs.
