O R D E R

(The case has been heard through video conference) The petitioner who apprehends arrest at the hands of the respondent Police for the offence punishable under Sections 341, 294(b), 323, 324, 506(ii) IPC in Crime No.664 of 2020, seeks anticipatory bail.

2.The case of the prosecution as per the defacto complainant Manikandan is that on 22.08.2020, the accused along with other accused, waylaid the defacto complainant and threatened him that he should not come to that area and also assaulted him. Hence, the complaint.

3.The learned counsel appearing for the petitioner would submit that the petitioner is an innocent and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4.The learned Government Advocate (Crl. Side) appearing for the respondent police would vehemently oppose stating that the petitioner is a habitual offender against whom there are six previous cases pending out of which, in three cases, NBW is pending against the petitioner.

5. Taking into account the nature of offence and the antecedents of the petitioner and the fact that NBW is pending against the petitioner in three cases, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition stands dismissed.
