A.D.JAGADISH CHANDIRA, J., The petitioner, who apprehends arrest at the hands of the respondent/ Police for the offences punishable under Sections 287, 337, 338, 308 and 34 of IPC in Crime No. 80 of 2009, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner is an employee of M/s.AML Factory and the defacto complainant is working as supply labour under contract. Due to lack of safety measures, fire accident had happened at the company, thereby many labourers had sustained burn injuries. Hence the complaint.
3. The learned Counsel for the petitioner would submit that the petitioner is an innocent person and a false complaint has been given against the petitioner and he has nothing to do with the alleged offence. He would further submit that the petitioner is ready to abide by any condition that may be imposed upon him. He would also submit that
inter-state anticipatory bail may be granted to enable the petitioner to move to the appropriate Jurisdictional Court in Jharkhand, for necessary relief. Hence, he prays for grant of interstate anticipatory bail to the petitioner.
4. Taking into consideration the facts and circumstances of the case, this Court is inclined to grant interim inter-state anticipatory bail to the petitioner for a period of four weeks from today to enable the petitioner to move to the concerned Court.
5. Accordingly, interim inter-state anticipatory bail is granted to the petitioner for a period of four weeks from today, on condition that the petitioner shall surrender before the learned II Metropolitan Magistrate, Egmore, Chennai, within a period of fifteen days from the date on which the order copy made ready and the petitioner shall execute a bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within two weeks from the date of execution
of bail bond, the petitioner shall approach the competent Court in Jharkhand and seek appropriate relief. If the petitioner fails to furnish sureties, the petition shall automatically stand dismissed. 14.06.2023 mfa Note: Issue Order copy on 15.06.2023.
