Criminal Original Petition filed under Section 438 of Cr.P.C., to grant anticipatory bail to the petitioner in the event of arrest by the respondent police in S.C.No.86 of 2010 on the file of the Principal District Judge, Chengalpet in Crime No.676 of 2009 on the file of the S-10, Pallikaranai Police Station, Chennai.

ORDER

(This case has been heard through video conference) This petition has been field for grant of anticipatory bail to the petitioner in the event of arrest by the respondent police in S.C.No.86 of 2010 on the file of the Principal District Judge, Chengalpet in Crime No.676 of 2009 on the file of the S10, Pallikaranai Police Station, Chennai. 2.The learned counsel for the petitioner would submit that the pettioner is an accused in Cr.No.676 of 2009 on the file of the S-10, Pallikaranai Police Station, Chennai. He would further submit that the petitioner was unable to appear before the learned Principal District Judge, Chengalpet, Kancheepuram and therefore, the Court has issued Non Bailable Warrant against the petitioner on 25.09.2018.

3. The learned Additional Public Prosecutor would submit that the case is of the year 2009 and the Sessions case is of the year 2010. He would further submit that the petitioner is A7 and he did not appear before the Court on 25.09.2018, therefore, the trial Court has issued Non Bailable Warrant against him.

4. In view of the above, this Criminal Original Petition is closed with direction to the effect that the petitioner shall surrender before the concerned Court and file an application to recall the Non Bailable Warrant and the trial Judge shall consider the same and pass appropriate orders on merits and in accordance with law.
