PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the first respondent to change from the T shape (T Arm) to L shape side arm (L Arm) in the EB OH cable in front of the petitioner's house as per the petitioner's application dated 9.11.2015. ORDER

Mr.M.Varunkumar, learned Standing Counsel accepts notice for the respondents. Heard Mr.P.Sidharthan, learned counsel for the petitioner. By consent, the writ petition itself is taken up for final disposal.

2. The petitioner is putting up a construction in his property and he is faced with the situation where there is a likelihood of his building coming in contact with the overhead power line. Therefore, the petitioner seeks to change from the T shape (T Arm) to L shape side arm (L Arm) in the Electricity https://hcservices.ecourts.gov.in/hcservices/

Board overhead cable in front of his house. The petitioner is also willing to pay necessary charges to carry out the said work. Expressing his grievance, he made an application to the fourth respondent on 9.11.2015. Therefore, the petitioner is before this Court.

3. The learned Standing Counsel for the respondents states that the fourth respondent may be directed to consider the petitioner's application and subject to payment of charges and feasibility, the fourth respondent will consider his request.

4. Accordingly, the writ petition is disposed of with a direction to the fourth respondent to consider the petitioner's application dated 9.11.2015 on merits, subject to feasibility and other conditions that may be imposed by the fourth respondent and pass appropriate orders thereon in accordance with law within a period of four weeks from the date of receipt of a copy of this order. No costs.
