The present Miscellaneous petition has been filed seeking to condone the delay of 191 days in filing the above criminal appeal.
2. Learned Additional Public Prosecutor appearing for the respondent has no objection for this petition being allowed.
3. Satisfied with the reasons stated in the affidavit in support of the petition and considering the inordinate delay, this Court considers it appropriate to allow this petition on payment of costs. Accordingly, this miscellaneous petition is allowed and the delay of 191 days in filing the above appeal, is condoned subject to payment of Rs.2,000/- (Rupees Two Thousand only) to the State Legal Services Authority, Chennai within a period of two weeks from the date of receipt of this order, failing which, the petition shall stand dismissed automatically, without further reference to this Court.
4. Upon production of necessary proof with regard to payment of cost as ordered by this Court, Registry is directed to number the criminal Appeal, if the papers are otherwise in order and post the main case for admission.
