Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondent to issue permanent community certificate in the prescribed format to the petitioner, that he belongs to Hindu Kattunayakan Community which is classified as Scheduled Tribe, based upon the community certificate already issued to the petitioner that he belong to Hindu Kattunayakan Community. O R D E R

(Order of the Court was made by HULUVADI G. RAMESH,J.) Heard Mr.V.Sivalingam, learned counsel appearing for the petitioner and Mr.R.Vijayakumar, learned Additional Government Pleader, who accepts notice on behalf of the respondent.

2. This Writ Petition is filed praying to issue a Writ of Mandamus directing the respondent to issue permanent community certificate in the prescribed format to the petitioner, that he belongs to Hindu Kattunayakan Community which is classified as Scheduled Tribe, based upon the community certificate already issued to the petitioner that he belongs to Hindu Kattunayakan Community.

It is averred in the Writ Petition that the petitioner's father and his two brothers have obtained community certificate in the prescribed format and the same has also been verified and certified to be genuine. It is further averred that since the petitioner is intending to apply for job in the Central Government, it is necessary for him to get the community certificate in the prescribed format and therefore, he applied for the same before the respondent on 06.10.2015 and subsequently made another application on 14.10.2015 requesting to issue community certificate in the prescribed format enclosing necessary documents, however, so far, the respondent had not acted on the same.

4. Mr.R.Vijayakumar, learned Additional Government Pleader, who was directed to take notice for the respondent submits that one month time may be given to the respondent to pass necessary orders.

5. In the light of the said submission, we direct the respondent to consider the application dated 06.10.2015 and 14.10.2015 made by the petitioner and verify the aspects as regards the Community Certificate already issued to the petitioner and his family members and pass necessary orders regarding issuance of community certificate, in accordance with law, within a period of one month from the date of receipt of a copy of this order.

6. The Writ Petition is disposed of with the above direction. No costs.
