The petitioner has filed this petition to condone the delay of 396 days in filing the appeal against the award passed by the Motor Accidents Claims Tribunal cum IV Additional District Court, Erode District, Bhavani, in MCOP No.459 of 2016, dated 22.11.2018.

2.Mr.D.Baskaran, learned counsel takes notice for the second respondent and he has got no serious objection in allowing the petition.

3. Considering the submissions made by the learned counsel and being satisfied with the reasons assigned in the affidavit filed in support of this petition, the delay is condoned and this petition is allowed.

In the event of the compensation amount is being enhanced, the appellant is not entitled for interest for the default period.

4. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise the papers are found to be in order and print the name of Mr.D.Baskaran, for 2nd respondent and post the matter on 27.11.2020 for admission.
