Elumalai, aged 51 years, (PID No. 271705) convict Prisoner No. 16846, now confined in the Central Prison, Cuddalore.

ORDER

(Order of the Court was made by Dr.Anita Sumanth J.) The petitioner has challenged the order dated 06.04.2026 so far as it relates to condition of escort to her husband, who has been granted 21 days Ordinary Leave.

Mr.Malarvannan, learned counsel for Government of Tamil Nadu (Criminal Side) does not very seriously object to this Court adopting the same approach as has been adopted in earlier orders of this Court [order dated 09.01.2025 in WP No.39659 of 2024] and modifying the conditions relating to escort.

3. Hence we reiterate grant of 21 days ordinary leave, though without escort under the following conditions:- (i) Respondents are directed to release the convict prisoner viz., Murugan, S/o. Elulmalai, aged 51 years, Convict Prisoner No.16846, now confined in Central Prison, Cudalore on Ordinary Leave for a period of 21 days i.e., from 08.06.2026 to 28.06.2026.

(ii) The convict prisoner shall be released on 08.06.2026 at 10.00 am and surrender before the Central Prison, Cuddalore on 29.06.2026 at 11.00 a.m. (iii) The convict prisoner is directed to report before the Inspector of Police, Villupuram Taluk Police Station, everyday at 11.00 a.m., during the leave period. (iv) The convict prisoner shall utilize the leave only for the ground on which it has been granted and shall not indulge in any other activities.

This writ petition stands allowed. No costs.
