The petitioner, who apprehends arrest for the alleged offences under Sections 379, 430 IPC and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, in Crime No.529 of 2021 on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner was involved in illegal transportation of 2 units of river sand by using a tipper lorry. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.

4.The learned Government Advocate (Crl. Side) appearing for the respondent submitted that this is the 5th anticipatory bail petition and the earlier anticipatory bails petitions filed by the petitioner were dismissed by this Court. He further submitted that the petitioner, along with other

accused persons, illegally transported 2 units of river sand by using tipper lorry without any valid permit. Therefore, he opposed for grant of anticipatory bail to the petitioner.

5.In view of the submissions made by the learned Government Advocate (Crl. Side) and since there is no change of circumstances for considering the present anticipatory bail petition filed by the petitioner, this Criminal Original Petition is dismissed.
