Lpf Auto Drivers Union v. M/S.Kuttys
W.M.P.No.17281 of 2022 in W.P.No.10655 of 2022 N.SATHISH KUMAR, J.
This petition is filed to recall the order passed by this Court in W.P.No.10655 of 2022 dated 23.06.2022, directing the respondent police to take action and to prevent the auto drivers from parking autos in front of the commercial building complex.
2.Today affidavit has been filed by the petitioner to that effect stating that the notice ordered by this Court was served on them only on 23.06.2022, therefore, they could not appear before this Court on the same day. The present petition is filed to recall the order passed by this Court on 23.06.2022 in W.P.No.10655 of 2022 and restore W.P.No.10655 of 2022 back to the file. 3.The records, whereas, produced before this Court indicate that the notice was served on them on 17.06.2022. Therefore, the very allegation pressed into service that they have received the notice only on 23.06.2022 is far fetched. The petitioner, has now come before this Court with different reasons.

kas 4.In such view of the matter, the petition filed by the petitioner is nothing but an abuse of process of law. It is not that the order was passed in respect of any immovable property to claim right over it, it is only a direction to the police to prevent the auto drivers from preventing ingress and egress of the respondent's building.
4.Such view of the matter, when the affidavit itself filed with false allegations, this Court cannot entertain this petition. This petition stands dismissed accordingly.
