ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, directing the Respondents 1 to 5, particularly the Respondents 2 to 5 for proper assessment and pay further fair compensation of the subject acquired land and building, situated at No.1/359, Pillaiyar Koil Street, Padur Village, Chengalpattu Taluk and District, Pin Code- 600 103, comprised in S.No. 645/36 (Village Nattham Old S. No.276/7), to an extent of 3723 sq.ft (346 Sq.mtrs) by considering the petitioner's representation dated 15.04.2026.

When this matter was taken up for hearing, the learned Government Advocate appearing for the respondents would submit that the petitioner has already filed a writ petition in W.P.No.46398 of 2023 with the very same prayer present writ petition and the same was disposed of on 04.12.2025. The prayer in the said writ petition reads as follows:-

"directing the Respondents 1 to 5, particularly the Respondents 2 to 5 for proper assessment and pay further fair compensation of the subject acquired land and building, situated at No.1/359, Pillaiyar Koil Street, Padur Village, Chengalpattu Taluk and District, Pin Code- 600 103, comprised in S.No. 645/36 (Village Nattham Old S. No.276/7), to an extent of 3723 sq.ft (346 Sq.mtrs) by considering the petitioner's representation dated 24.10.2026."

3. A reading of the above prayer in the earlier writ petition, it appears that the prayer in the present writ petition and the earlier writ petition are one and the same. While disposed of the earlier writ petition on 04.12.2025, this Court recorded the submission of the learned counsel for the respondents that time limit for seeking a reference under Section 20 of the Highways Act has got expired therefore, the request of the petitioner cannot be countenanced.

4. In such being the case, once again filing a writ petition with the very same prayer is clearly amounts to abuse of process of law. Hence, this Writ Petition is dismissed with cost of Rs.5,000/- payable by the petitioner to the State Legal Services Authority within a period of two weeks time from the date of receipt of a copy of this order. In the event if the petitioner fails to make payment, the 1st respondent is directed to recover the cost and deposit the same in its account as per Revenue Recovery Act as against the petitioner.
