Respondents PRAYER: The Writ petition filed under Article 226 of the Constitution of India seeking to issue a Writ of Mandamus forbearing the respondents 3 to 5 from altering the service conditions of the 123 members of the petitioner Union, whose names are given in the annexure to the Writ petition in any manner including discontinuance of service without getting permission under Section 33 of the Industrial Disputes Act, 1947 in the Industrial Dispute dated 20.06.2022 raised regarding regularization of the 123 employees shown in the annexure to the Writ petition which is pending conciliation before the 2nd respondent as Dispute No.8/27/2022 B3 and to direct the 2nd respondent to conciliate the dispute and effect settlement and if no settlement is forthcoming to submit failure report under Section 12(4) of the Industrial Disputes Act to the 1st respondent and in turn direct the 1st respondent Government to refer 2/5
the dispute for adjudicaton before the competent adjudicator. For Petitioner :

Both sides' counsels present and represented that a fresh contract was awarded and the employees in the petitioner Union were replaced as fresh contract employees. Therefore, the prayer in this petition becomes 'infructuous'. The petitioner Union is at liberty to approach the Labour Court for appropriate remedy..
2. Considering the above submissions made by the learned counsels appearing on either side, the Writ petition is closed. There shall no order as to costs. Consequently, the connected miscellaneous petitions are closed. 3/5
