2. The brief facts which has culminated in the filing of these writ petitions are set out below:
2.1. It is the case of the petitioner that they were working as Checking Inspector and Senior Tradesman in the respondent Corporation and retired from service. The respondents settled their Provident Fund, Earned Leave Salary, Gratuity and Pension Commutation with a delay of more than 223 days and 284 days respectively. Therefore, the respondents are legally bound to pay interest to the petitioners. Therefore, the petitioners made a representation to the respondents to pay the interest at the rate of 9% p.a., for the belated payment of the petitioners' Provident Fund, Earned Leave Salary, Gratuity Amount and Pension Commutation Amount. Since there is no response, the petitioners are before this Court.
3. Heard the learned Counsel on either side and perused the materials available on records.
4. Admittedly, the Provident Fund, Earned Leave Salary, Gratuity Amount and Pension Commutation Amount has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petitions are allowed as prayed for and a mandamus is
issued directing the respondents to disburse the 6% interest for belated payment of Provident Fund, Earned Leave Salary, Gratuity Amount and Pension Commutation Amount to the petitioners within a period of one (1) month from the date of receipt of a copy of this order.
