RESPONDNETS Prayer: The Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to grant incentive increments for the petitioner's higher qualifications by disposing the petitioner's representation dt 6.6.2014 based on the G.O.Ms. No.42 dt 10.1.1969 and G.O.Ms. 324 dt 25.4.1995 and the letter dt 21.11.2014 issued by the 1st respondent and the order passed in W.P. No. 33170 of 2007 dt 19.3.2015 passed by this Honourable Court.

By consent, the writ petition is taken up for final disposal at the admission stage itself.

2. According to the petitioner, she had successfully completed B.Com., M.Com., and D.T.Ed Courses. She was appointed as Secondary Grade Teacher by an order dated 15.07.2009 and thereafter, she acquired additional qualification of M.Com., B.Ed.,.

The grievance expressed by the petitioner is that the benefit, as per G.O.Ms.No.42, dated 10.01.1969 and G.O.Ms.No.324, dated 25.04.1995, was not extended for acquiring additional qualification and therefore, she made a representation to the second respondent dated 06.06.2014. Since it was not considered, the present writ petition has been filed.

4. Heard Mr.D.Geetha, learned counsel for the petitioner and Mr.S.Gunasekaran, learned Government Advocate for the respondnets.

5. Though the petitioner prayed for a larger relief, this Court, in the light of the facts and circumstances and without going into the merits of the case, directs the second respondent to consider and dispose of the petitioner's representation dated 06.06.2014 on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioners.

6. With the above said direction, the writ petition is disposed of accordingly. No costs.
