Respondents Prayer:
Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records of transfer counselling held on 6.6.2018 in so far as the petitioner is concerned pursuant to 2nd Respondents Circular bearing Ref No.6789 / E3 / 12018 dated 29.05.2018 and quash the posting order of the 2nd Respondent wherein the 3rd Respondent who never participated in the counselling held on 6.6.2018 joined duty on 20.6.2018 at Trauma care, CMCH, Coimbatore, being illegal, violative of instructions contained in circulars, ultra vires, issued on extraneous consideration and cannot be sustained during the pendency of the representation dated 6.6.2018 submitted to the 2nd Respondent by the petitioner for transfer to Trauma Care, CMCH, Coimbatore and further direct the 2nd Respondent to consider the petitioner's transfer posting to Trauma Care, CMCH, Coimbatore since the petitioner fulfills the criteria prescribed by the circulars of the 2 nd respondent in respect of transfer/postings.
