Application No. 4704 of 2023 in Arbitration O.P. D. No. 71435 of 2022 C.V.KARTHIKEYAN, J.

This application has been filed seeking to condone the delay of 15 days in filing the Arbitration Original Petition questioning the award passed by the first respondent by order dated 02.03.2022.

2. In the affidavit filed in support of the petition, it had been stated that deponent who is working as Project Director, National Highways Authority of India had to collect documents and thereafter, to give instructions to prepare the Original Petition.

3. It had been stated that there are legally sustainable grounds available for questioning the award passed. It is urged that the petition should be heard on merits.

4. Notice had been directed to the respondent and notice had also been served and the counsel also had entered appearance.

5. Taking all the factors into consideration, the petition stands allowed.

6. Registry is directed to number Arbitration O.P. D. No. 71435 of 2022, if it is otherwise in order.
