A.No.3062 of 2023 has been filed by the first defendant to receive certain e-mail communications between the first respondent / plaintiff and his brother.

A.Nos.3063 & 3064 of 2023 has been filed by the first defendant to recall and reopen the evidence of P.W.1 E.Rajavelu for further examination and mark the documents listed in the Schedule and mark the same.

2. The learned counsel for the applicant / first defendant submitted that the trial in this matter was over on 15.12.2022 and subsequent to that the first e-mail has been sent on 30.01.2023 and the correspondence have been taken place till 26.02.2023, totally five events.

3. Though the applicant / first defendant intended to recall P.W.1 in order to mark these documents through P.W.1, the first respondent / plaintiff did not have any objection. The other second respondent / second defendant also did not have any serious objection. 1/3

4. Since the respondents did not have any serious objection to receive and recall the witnesses for the above said specific purpose, I feel that these applications should be allowed.

5. Accordingly, the applications in A.Nos.3063 & 3064 / 2003 are allowed and A.No.3062/2003 is allowed subject to proof and relevancy. 22.06.2023 bkn 2/3
