PRAYER : Writ Petition filed Under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 2nd respondent to consider the petitioner's application dated 16.7.2013 and thereby direct the 2nd respondent to provide domestic service connection to the petitioner's residential property situated at No.87, 1st Street, Anna Nagar, Veppampattu Village and Post, Tiruvallur Taluk and District in the name of the petitioner on receipt of appropriate cost from the petitioner.

The relief sought for in the present writ petition is to direct 2nd respondent to consider the petitioner's application dated 16.07.2013 and to direct the 2nd respondent to provide domestic Electricity Service Connection.
2. The learned counsel appearing on behalf of the respondent-Electricity Board made a submission that the petitioner has not submitted all the required documents for the purpose of considering the application, so as to provide Service connection.

The counter affidavit filed by the second respondent also reveals that the President/Executive Officer, Veppampattu Village Panchayat under Thiruvallur Town Panchayat, Thiruvallur had sent an eviction notice dated 18.07.2013 to the writ petitioner, so as to evict the unauthorized occupation of the land in Pattaraithangal Survey No.204 at No.87, 1st Street, Anna Nagar, Veppampattu Village & Post, Thiruvallur Taluk & District by giving 15 days to vacate.
4. If at all the petitioner is an unauthorized occupant, the competent authorities are bound to initiate appropriate action. The Superintending Engineer filed a counter, stating that eviction notice had already been issued on 18.07.2013. As far as the application submitted by the petitioner for providing Electricity Service connection is concerned, only in the event of filing all relevant documents as per the Regulations, the authorities would be in a position to consider the application. Thus, there is no infirmity in not considering the application.
