Prayer in Criminal Revision SR: This petition is filed to set aside the order dated 16.11.2015 passed in M.C.No.154 of 2013 on the file of the learned Principal Judge (Additional Family Court), Coimbatore and set aside the same.

O R D E R

The learned counsel appearing for the petitioner has submitted that the petitioner in this case died two weeks ago. To that effect, he has filed a Memo dated 19.09.2016 and the relevant portion of the same reads as follows: "It is humbly submits that the petitioner had filed the above Criminal Revision against the order of the Hon'ble Additional Principal Judge (Additional Family Court), Coimbatore, in M.C.No.154 of 2013, dated 16.11.2015.

The above Criminal Revision came before the Hon'ble High Court, Madras on 12.09.2016 for condone the delay in https://hcservices.ecourts.gov.in/hcservices/

Crl.M.P.No.7429 of in C.R.L.RC.SR.No.25733 of 2016 and this Hon'ble Court directed the petitioner counsel to publish the case in the news paper for the appearance of the respondent. As per order of the Hon'ble High Court, the petitioner counsel published the case in the Maalai Malar news paper, Coimbatore edition on 16.09.2016.

It is further submits that the lower court counsel informed to the petitioner counsel bring the said information before due to the health problem. Hence, the petitioner counsel bring the said information before this Hon'ble Court, by filing this memo, so as to unable to continue further proceedings in the above said criminal revision."

The said Memo dated 19.09.2016 is recorded. Accordingly, the Criminal Miscellaneous Petition is dismissed. Consequently, Crl.RC.SR.No.25733 of 2016 is also dismissed.
