Petition under Article 226 of the Constitution of India praying for issue of a Writ of Mandmus directing the 1st and 2nd respondents to consider the petitioner's representation dated 15.07.2015 and consequently, to take action as against the 5th respondent herein within a time frame as stipulated by this Court.

By consent, the main writ petition is taken up for final disposal at the admission stage itself. With the grievance that the 5th respondent is causing health hazard by dumping garbage, adjacent to the petitioner's land, the petitioner made a complaint to the Secretary, Pollution Control Board on 15.07.2015. The Tamil Nadu Pollution Control Board has also directed the 3rd respondent to take appropriate action, as could be seen from its proceedings dated 31.07.2015. Despite the same, no action has been taken by the 3rd respondent so far. Hence, the petitioner has come forward with the present writ petition.

Though the prayer sought is for a direction to respondents 1 and 2 to consider the representation of the petitioner dated 15.07.2015, considering the above facts, the 3rd respondent is directed to take appropriate action, in accordance with law, in the light of the communication issued by the Pollution Control Board dated 31.07.2015, on the representation of the petitioner dated 15.07.2015, within a period of six weeks from the date of receipt of a copy of this order, after affording an opportunity to the petitioner as well as to the 5th respondent. The writ petition is disposed of accordingly. No costs. Connected M.P. is closed.
