This petition is filed seeking to restore the above second appeal, which was dismissed for non prosecution on 07.06.2023 by setting aside the said order, in the interest of justice.

2.Heard the learned counsel for the petitioners as well as the learned counsel for the respondents.

3.Being satisfied with the reasons stated in the affidavit filed in support of the petition, this petition is ordered and the Second Appeal No.1007 of 2009 is restored to file.

4.Registry is directed to post the matter on 09.08.2024.
