A.Nos.2957 & 2958 of 2023 in C.S.No.996 of 2016 R.N.MANJULA, J.

A.No.2957 of 2023 has been filed to grant leave to the applicant / first defendant to mark a copy of the Affidavit of Undertaking dated 19.07.2022 as an Additional Document on the side of the first defendant. A.No.2958 of 2023 has been filed to receive the Affidavit of Undertaking dated 19.07.2022 as an Additional Document, on the side of the first defendant.

2. These applications have been filed by the applicant / first defendant consequent to the order dated 06.06.2023. Earlier the applications with similar relief have been filed in A.No.2491, 2492 & 2493 of 2023 to recall D.W.1, for further examination and also seeking direction against D2 and D3 to produce certain documents. Since the respondents have severely objected to the frame of the application and the reliefs, a detailed order has been passed after hearing both sides by giving liberty to take out a fresh application.

4. Now these application have been filed consequent to the order dated 06.06.2032. Hence these applications need to be allowed.

5. Accordingly A.Nos.2957 & 2958 /2023 are allowed on the condition that the applicant should pass the test of proof and relevancy of the additional document at the time of trial.
