Learned advocate for the petitioner/ appellant states that the second respondent is not appearing even before learned single Judge and the endorsement shows unclaimed.

Having heard the learned advocates for the respective parties and having considered the material on record, this Court finds that the delay is properly explained. Delay is condoned and this petition is allowed.
