2. The present petition has been filed under Section 24 of CPC seeking withdrawal of H.M.O.P.No.159 of 2024 from the file of the Sub Judge, Uthangarai, Krishnagiri District and transfer of the same to the file of the Sub 1/4

Court, Vaniyambadi.

3. The petitioner is the wife of the respondent. The marriage between the petitioner and the respondent was solemnized on 30.10.2022 at S.S. Mahal, Valayampattu, Vaniyambadi District, as per Hindu rites and rituals, and the same was registered on 25.11.2022 before the Sub Registrar, Uthangarai, Krishnagiri District. The case of the petitioner is that the respondent is her husband and that the respondent has instituted the above H.M.O.P. seeking divorce. The petitioner states that she is presently residing at Vaniyambadi, Tirupattur District, and that she has no independent means to frequently travel and attend the proceedings at Uthangarai, which, according to her, causes hardship and inconvenience. The petitioner therefore seeks transfer of the matrimonial proceedings to the Court at Vaniyambadi.

It is well settled that, while exercising power under Section 24 CPC, the Court has to consider the ends of justice, and in transfer petitions relating to matrimonial proceedings, the convenience and difficulties of the wife in attending the Court proceedings is a relevant and significant consideration, particularly when she pleads financial constraints and travel hardship. 2/4

5. In the case on hand, the petitioner has specifically pleaded difficulty in travelling and attending the proceedings at Uthangarai and has sought transfer to Vaniyambadi, where she resides. Considering the nature of the lis and the circumstances pleaded, this Court is of the view that transfer of the proceedings would subserve the ends of justice. No serious prejudice would be caused to the respondent by such transfer.

6. Accordingly, Tr.C.M.P.No.605 of 2025 is allowed. H.M.O.P.No.159 of 2024 on the file of the Sub Judge, Uthangarai, Krishnagiri District, is withdrawn and transferred to the file of the Sub Court, Vaniyambadi, Tirupattur District. The Sub Judge, Uthangarai, shall transmit the entire records to the Sub Court, Vaniyambadi, within three (3) weeks from the date of receipt of a copy of this order and the Sub Court, Vaniyambadi shall dispose of the matter in accordance with law, as expeditiously as possible, uninfluenced by any observations made in this order. There shall be no order as to costs.
