The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 7, 20(1) of Cigarette and other Tobacco Products Act, 2003 and Section 328 of IPC in Crime No. 150 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner is alleged to have transported 9092 kgs of Tobacco products illegally in the TATA Motors vehicle bearing Registration No.TN-22-DH-1792. Hence, the complaint.

3. The learned counsel appearing for the petitioner is the owner of the vehicle and already gave a vehicle for a rental purpose. He would further submit that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor would submit that this the third anticipatory bail petition. Earlier petitions filed by the petitioner before this Court in Crl.O.P.No.13275 of 2022 was dismissed on 09.06.2022 and Crl.O.P.No.14753 of 2022 was dismissed on 27.06.2022. 6. Considering the nature of offence committed by the petitioner and taking note of the fact that this Court had dismissed the earlier petitions filed by the petitioner and that there is no change of circumstances. Therefore, this Court is not inclined to grant bail to the petitioner.
