(The case has been heard through video conference) The contempt petition has been filed to punish the Inspector of Police, Gingee Police Station,Villupuram District, according to law who deliberately 1/3
disobeyed the order of the Court passed in Crl.O.P.No.2 of 2014, dated 06.01.2014.
2. The learned counsel for the petitioner is absent. 3.Mr.Anbukarasan, the Inspector of Police, Gingee Police Station is present before this Court. He would submit that the order of this Court has been complied with as early as on 16.03.2016. He would submit that this Court had directed the respondent to complete the investigation as expeditiously as possible, preferably within a period of six months from the date of receipt of a copy of the order. The respondent sincerely conducted the investigation, however, due to transfer of some of the officers, there had been some delay and the investigation was completed and final report has been filed on 16.03.2016, referring the case as mistake of fact and due notice was also served on the defacto complainant and the case was taken in R.C.S.No.18 of 2016, on the file of the learned Judicial Magistrate, Gingee. He would apologize for the delay in complying with the order.
4,The learned Additional Public Prosecutor would submit that it is a case relating to forgery of documents and there was some delay in getting the opinion from the concerned authorities, thereby, there was a delay. Further, the respondents have duly conducted the investigation and after thorough 2/3
investigation referred the case as mistake of fact and final report has also been filed on 16.03.2016, referring the case as mistake of fact. He would pray that the apology rendered by the respondents be accepted. 5.The apology is accepted. In view of the fact that the order of this Court has been complied with as early as on 16.03.2016, this Contempt Petition stands closed.
