Respondents Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Mandamus, directing the respondents to pay compensation for the death of the petitioner's son Thoufiq Ahmed who died on 16.07.2022 by accidentally coming in contact with the live overhead electric line running close to the petitioner's house by considering his representation dated 26.09.2022.

O R D E R

The son of the writ petitioner, admittedly, died on account of electrocution on 16.07.2022 at around 01.15 P.M.

2. The death of the son of the writ petitioner due to electrocution, has not been disputed by the respondents. The Government also paid a sum of Rs.1 lakh to the petitioner under the Government Orders. However, the TANGEDCO is bound to settle a sum of Rs.5 lakhs towards compensation as per the proceedings issued in TANGEDCO Proceedings No.68 dated 14.11.2019.

3. The compensation is being granted on compassionate grounds by the TANGEDCO and therefore, the third respondent is directed to settle a sum of Rs.5 lakhs along with interest at the rate of 6% per annum from the date of death till the date of payment, to the petitioner, within a period of eight weeks from the date of receipt of a copy of this order.

4. With the above directions, the present writ petition stands allowed. However, there shall be no order as to costs. 12-04-2024 Index : Yes/No Internet: Yes/No Speaking order/Non-Speaking order Svn
