Learned counsel for the appellant submitted that the appellant is withdrawing the appeal.

2. Learned counsel for the respondent has opposed the same stating that since the appeal is admitted and respondent was also heard and at this point of time, the appellant has come forward to withdraw the same.

3. Taking into consideration the submission made by the learned counsel for the appellant, the appellant is permitted to withdraw the appeal with liberty to the respondent to file separate appeal for enhancement.
