This Criminal Original Petition has been filed by P.W.2, father of the deceased.
2. The respondent police registered the case against the private respondents for the offence under Sections 498(A) and 304(B) IPC. After conclusion of trial, the trial Court acquitted private respondents No.2 and 3/accused No.1 and 2. Challenging the same, the father of the deceased wants to file an Appeal. Since the Appeal is against the judgment of acquittal, the Criminal Original Petition has been filed to seek the leave of this Court to file an Appeal.
3. Heard the learned counsel for the petitioner and perused the grounds of Appeal and there are arguable points raised in the Memorandum of Grounds of Appeal. Therefore, Leave is granted. http://www.judis.nic.in
4. Registry is directed to number the appeal if it is otherwise in order.
5. Mr.S.Sugendran, learned Government Advocate takes notice on behalf of the official respondent/respondent No.1.
6. Issue notice to R2 and R3 returnable in three weeks. Private notice is also permitted. Proof of service to be filed by then.
