O R D E R

This Writ Petition has been filed for declaring the clause 5 of the circular issued by the respondent in Circular No.13/2008 Na.Ka.No.AA1/65368/2007 dated 06.07.2008 as null and void.

2. The learned counsel appearing for the petitioner would submit that nothing survives in this Writ Petition and sought for dismissal of the same. He has also made an endorsement to the following effect:- "Nothing survives in the above said Writ Petition and the same may be dismissed as infructuous".

3. Recording the above submission and the endorsement made by the learned counsel for the petitioner, the Writ Petition is dismissed as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
