PRAYER: Criminal Original Petition filed under Section 482 of the Cr.P.C., to direct the respondents 1 to 3 to not to harass the petitioners and their son Arunkumar in any manner whatsoever based any complaint given by the 4th respondent. For Petitioners : Mr.Saravanan Vel, J.

O R D E R

This Criminal Original Petition has been filed to direct the respondents 1 to 3 to not to harass the petitioners and their son Arunkumar in any manner whatsoever based any complaint given by the 4th respondent.

2. Heard learned counsel appearing for the petitioners and learned Additional Public Prosecutor appearing for respondents 1 to 3.

3. It is also seen that the petitioners have been called for an enquiry with regard to a matrimonial dispute between the petitioner's son and the daughter of the fourth respondent. The petitioner's son has filed a petition in HMOP No.830 of 2017 before the Sub Court, Tambaram to dissolve the marriage, which was solemnized between the petitioner's son and the daughter of the respondent. Pending the same, the second respondent respondent filed a petition in HMOP No.504 of 2017 before the Family Court, Chennai for restitution of conjugal rights.

4. In the facts and circumstances of the case, there shall be a direction to the third respondent to conduct an enquiry and take further action in accordance with law. It is made clear that if the third respondent finds that it is a matrimonial dispute, the third respondent police shall relegate the parties to approach the appropriate Family Court.

5. With the above direction, this Criminal Original Petition is disposed of.
